  • EDUHERO and REGION 6 EDUCATION SERVICE CENTER (the "Company") is committed to maintaining robust privacy protections for its users ("you"). Our Privacy Policy ("Privacy Policy") is designed to help you understand how we collect, use, and safeguard the information you provide, and assist you in making informed decisions when using our Service.
  • For purposes of this Agreement, "Site" refers to the Company's website, www.eduhero.net.
  • "Service" refers to the Company's services accessed via the Site, in which users can log in, complete courses via the Online Course Catalog (OCC), track usage or completions, and report to superiors.
  • The terms "we," "us," and "our" refer to the Company.
  • "You" refers to you as a user of our Site or Service.
  • By accessing our Site or our Service, you accept our Privacy Policy and Terms & Conditions (found here: www.eduhero.net/terms.php), and you consent to our collection, storage, use, and disclosure of your Personally Identifiable Information or PIIas described in this Privacy Policy.
  1. INFORMATION WE COLLECT

    We collect "Non-Personally Identifiable Information" and "Personally Identifiable Information."

    Non-Personally Identifiable Information:

    This refers to information that cannot be used to identify you personally. We gather certain information about you based on where you visit our site in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the Website's Uniform Resource Locator ("URL") that you just came from, which URL you next go to, what browser you are using, and your Internet Protocol ("IP") address. A URL is the global address of documents and other resources on the World Wide Web. An IP address is an identifier for a computer or device on a Transmission Control Protocol/Internet Protocol ("TCP/IP") network, such as the World Wide Web. Networks like the Web use the TCP/IP protocol to route information based on the IP address of the destination. In other words, an IP address is a number that is automatically assigned to your computer whenever you are surfing the web, allowing web servers to locate and identify your computer. Computers require IP addresses for users to communicate on the internet.

    Personally Identifiable Information (which includes “Covered Information” under Texas Education Code 32.151) This refers to information that lets us know the specifics of who you are. This includes your email, name, birth year, and Google login information which you submit to us through the registration process at the Site. Google access is only requested when using the Google login information, and is completely optional. We use the Google login information for the creation and sharing of custom courses. If this is a problem for you, please log in using the standard email and password method on Eduhero. Eduhero may utilize other Single Sign-On (SSO) applications in the future which have not been specified here. If such applications are utilized the information noted above will also be collected in a manner necessary to serve their functionality.

    1. Information collected via Technology

      To activate the Service you do not need to submit any Personally Identifiable Information other than your email address, name, and birth year. To use the Service thereafter, you do not need to submit further PII. However, in an effort to improve the quality of the Service, we track information referred to in 1. Information We Collect using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user's browser from our servers and are stored on the user's computer hard drive. Sending a cookie to a user's browser enables us to collect Non-Personally Identifiable Information about that user and keep a record of the user's preferences when utilizing our services, both on an individual and aggregate basis. For example, the Company may use cookies to collect the following information:

      • Pages Visited
      • Login date and time

      The Site may use both persistent and session cookies ; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser. This is how we keep you logged in after a set amount of time.

    2. Information collected via Account Registration

      In addition to the information provided automatically by your browser when you visit the Site, to become a user to the Service you will need to create a personal profile. You can create a profile by registering with the Service and entering your email address and creating a password . By registering, you are authorizing us to collect, store and use your email address in accordance with this Privacy Policy.

    3. Children's Privacy

      1. Family Educational Rights and Privacy Act (FERPA): Region 6 Education Service Center is recognized as a state or local educational authority under FERPA. As such, we are authorized to receive and process Education Records, which may include Personally Identifiable Information. Although we possess such authorization, the processing of Education Records in conjunction with the services provided by this site is rare. All information collection of minors is minimal and only for the purposes of operating the Site.
      2. The Site does not knowingly collect or solicit information from anyone under the age of 13, unless or until a student's relevant District has provided consent and authorization for a student to access our services. For students of all ages, we only process such information necessary to provide our services to the student for the purposes set forth by this Policy. In the event that we learn that we have gathered Personally Identifiable Information from anyone under the age of 13 without the consent of a parent or guardian or the authorization of the relevant school district, we will delete the information as soon as possible.   2. HOW WE USE AND SHARE INFORMATION

    Personally Identifiable Information:

    Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personally Identifiable Information with third parties without your consent.

    In general, the PII you provide to us is used to help us communicate with you. For example, we use PII to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers. We provide some services through contractual arrangements with affiliates, services providers, partners and other third parties. We and our service partners use your PII to operate our sites and to deliver services. We will encourage our service partners to adopt and post privacy policies. However, the use of your PII by our service partners is governed by the privacy policies of those service partners, and is not subject to our control. Additionally, employers who may subscribe on behalf of a user are entitled to applicable records of the user for their own purposes.

    Occasionally we may be required by law enforcement or judicial authorities to provide PII to the appropriate governmental authorities.     1. Non-Personally Identifiable Information and the Transfer of Personally Identifiable Information

      In general, we use Non-Personally Identifiable Information to help us improve the Service and customize the user experience. We also aggregate Non-Personally Identifiable Information in order to track trends and analyze use patterns on the Site. This Privacy Policy does not limit in any way our use or disclosure of Non-Personally Identifiable Information and we reserve the right to use and disclose such Non-Personally Identifiable Information to our partners, advertisers and other third parties at our discretion.

      In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personally Identifiable Information may be among the assets transferred.     1. You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. You can also indicate that you do not wish to receive marketing communications from us in the Account Settings portion of the Site. Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out at https://eduhero.net/account.php, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy.
    2. You also have choices with respect to cookies, as described above. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies, some parts of The Site may not work properly.
    3. As a user of our Service, you have certain rights concerning your Personally Identifiable Information, which are subject to our legal and regulatory obligations:

  5. INCIDENT RESPONSE

    In the event of a data breach or security incident, our commitment is to ensure transparency and swift action. We will notify affected users within 72 hours of identifying the breach, where feasible. In compliance with Texas Business And Commerce Code §521.053, our notification will include details about the nature of the breach, the data involved, the potential impact on our users, and the steps taken to address the breach. All notifications will be provided electronically in compliance with 15 USC §7001. Additionally, we will cooperate with regulatory authorities as required by law to handle the situation appropriately.   6. DATA RETENTION POLICY

    Handling of Google User Data

    Our platform enables users with certain Control Panel access to upload content from Google Drive and manage this content through Google's native settings. Responsibility for the management, retention, and deletion of Google user data accessed or stored via our Service rests solely with the user. Our platform does not automatically delete Google user data; it is retained indefinitely as per user management within their Google Drive settings.

    As such, our users are encouraged to familiarize themselves with Google's data management tools and settings to effectively control access to and management of their data. For information on how to manage or delete data stored in Google Drive, users can refer to Google’s support resources or directly manage their settings within Google Drive.

    Our policy is designed to clarify that while our platform facilitates access to Google Drive for enhanced functionality, all management of Google user data is governed by the user's own use of Google's tools and their compliance with Google's policies.

    General Policy

    We retain Personally Identifiable Information and Non-Personally Identifiable Information as long as necessary to provide our services and for legitimate business purposes, such as complying with our legal obligations, resolving disputes, and enforcing our agreements. Due to the nature of our services, providing professional development and compliance training, we retain user data indefinitely to comply with applicable legal and regulatory standards.
